Alleged failures
The complaint alleges the following failures:
- Staff failed to assess the resident’s risk of pressure ulcers and failed to provide a proper mattress, bedding, and pressure-relief devices.
- Staff failed to provide timely wound care and dressing changes and failed to monitor and treat the ulcers as they progressed.
- Staff failed to notify a physician of significant changes in the resident’s condition and failed to keep complete and accurate records.
- The corporate owners hired too few registered nurses, licensed practical nurses, and certified nurse assistants and allocated budgeted funds in ways that left staffing and supplies insufficient.
- The complaint pleads corporate negligence, negligence by the facility administrator, medical malpractice, fraud, a statutory claim under the Bill of Rights for Residents of Long-Term Care Facilities, and wrongful death, and attaches an expert affidavit under O.C.G.A. § 9-11-9.1.
