Northside Hospital complaint alleges improper surgical-equipment operation before a patient’s thermal burns

The complaint alleges that a patient underwent a diagnostic hysteroscopy and resectoscopic polypectomy at Northside Hospital on October 23, 2023, performed by two physicians. During the procedure she sustained severe thermal burns to her abdomen, which the complaint says resulted from negligent operation or supervision of the surgical equipment. It alleges the burns were not a recognized or unavoidable risk of the procedure when performed with reasonable care. It also alleges that the surgeons did not identify or address the burns during or immediately after surgery.   4. She was left with physical burns, scarring, disfigurement, pain and suffering, emotional distress, and related medical expenses.

Alleged failures

The complaint alleges the following failures:

  • Dr. Feuer and Dr. Oso improperly operated or supervised the operation of the surgical equipment used in the procedure.
  • They did not maintain a safe surgical field or otherwise prevent the thermal injury.
  • They did not adequately supervise the assisting staff during the procedure.
  • The filing alleges the hospital was negligent in hiring, retaining, and supervising the personnel involved.
  • The complaint pleads medical malpractice and gross negligence against the two physicians, ordinary negligence against all defendants, and vicarious liability against Northside Hospital. It also pleads negligent hiring, retention, and supervision, general and special damages, punitive damages, and attorney’s fees. It attaches an expert affidavit under O.C.G.A. § 9-11-9.1.
